Contact Evan Samuelson, Attorney At Law, regarding any of the following legal practice areas that make up our law practice:
Family law: A knowledgeable and attentive family law attorney is a valuable source of information and practical assistance at times of transition and change in family structure. Contact Evan Samuelson, Attorney at Law, regarding virtually any legal family law matter, from the simple to the most complex, including divorce, child custody, post-judgment modifications, domestic violence, move-aways, tracing issues, finding hidden income and many other issues and concerns.
Divorce and legal separation: A divorce or legal separation case starts with one spouse (the petitioner) filing a petition with the court, and then delivering a copy of the petition to the other spouse (the respondent). The divorce or legal separation will end by trial or by the spouses entering into a Marital Settlement Agreement.
Property division: The family law attorneys and the judge are required to trace where a particular item of property came from, how it was acquired, what the intent of the spouses was at the time the property was acquired, and what portion of that property is community property and what portion is separate property.
Marital settlement agreements, prenuptial agreements: The purpose of a marital settlement agreement is to settle disputes over child custody, child support, spousal support, and property division, thereby alleviating the need to go to trial and have a judge make decisions on these issues.
Child custody: Physical custody designates with whom a child is actually living, while legal custody designates which parent gets to make decisions regarding the child's health and welfare.
Post-judgment modifications: As your family law attorneys, we can file motions with the court that ask the judge to modify prior child custody, child support or spousal support orders to accommodate new circumstances.
Child support: When a parent is self-employed and running a business, the parent can control what his/her income looks like, making it necessary to review business documents to determine what money is truly available for support purposes.
Spousal support: Some of the factors listed in Section 4320 that the judge must consider are: length of marriage; age and health of the spouses; earnings or earning capacities of the spouses; the amount of assets the spouses will have to live on; the duty of each spouse to make diligent efforts to become self supporting; and the marital standard of living.
Bankruptcy: If you are contemplating bankruptcy (either Chapter 7 or Chapter 13), please call our office to schedule a free consultation.
